STATEMENT OF PURPOSE

Planning and organizational efforts over the past several years have created excellent opportunities for urban development at Summit Pointe. Indeed, Summit Pointe is poised to emerge as a new downtown for Chesapeake – to become the newest lifestyle community in Coastal Virginia. The Summit Pointe Architectural Review Committee (“SPARC”) has created this Governance section of our website to assist owners and developers in responding to these opportunities and help shape the future of this dynamic community.

This governance section is intended to serve as a general guide to the resource documents available to owners and/or interested developers to the procedures being implemented, but also as a guide to tenants and residents about the rules and regulations governing our community. The various tabs within this Governance section are intended to be as informative as possible.

The Summit Pointe Owners’ Association (“SPOA”) has taken a number of steps to create an efficient architectural review process and to ensure the internal preservation of individual property owners’ rights. In order to briefly acquaint you with these issues and the processes that SPARC has been empowered to use, a comprehensive outline is provided in this governance section.

This governance section is intended to be as informative as possible and to assist you in obtaining the best possible value for your property. Knowledge of the process along with an understanding of the opportunities and restrictions to urban mixed-use development in Summit Pointe are an essential part of that process

SUMMIT POINTE OWNERS’ ASSOCIATION

As the non-profit corporation representing the property owners of Summit Pointe, the goal of the Summit Pointe Owners’ Association is to preserve and enhance asset values by ensuring the overall architectural harmony of development and property usage for the benefit of all businesses within Summit Pointe.

This shared vision of Summit Pointe’s development quality has been a foundational concept for the community. Summit Pointe will have the size and scale of a central business district, and the Summit Pointe Owners’ Association Board provides the necessary oversight and management of its many amenities, and daily operations, including common area maintenance, architectural review and administration of the overall association budget. Such vigilance in sound management practices delivers the highest standards of quality within Summit Pointe.

Each owner in Summit Pointe contributes funds to the Association based on a budget prepared annually and approved by the property owners.

SUMMIT POINTE COVENANTS

From its inception, Summit Pointe has been a carefully planned urban mixed-use community with protective land use and architectural covenants implemented to provide a means for creating, maintaining, controlling and preserving it as a high-quality lifestyle community.

The Summit Pointe Protective Covenants, provided below, ensure that the community will be developed, improved and used in such a manner that all developments will provide a harmonious, appealing appearance and function, that land uses will be compatible and complementary, and that property owners will be protected against any use of other land located in Summit Pointe which might unreasonably depreciate or detract from the value and use of their land or property.

In addition to its Covenants, the Summit Pointe development is also governed by its underlying rezoning case. A copy of the Covenants and zoning case are provided below.

COMMUNITY RULES & REGULATIONS

Summit Pointe will be operated and managed as a cohesive urban community under a harmonious set of rules and regulations. The document below will be used to govern our community for the benefit of all.

SUMMIT POINTE ARCHITECTURAL REVIEW STANDARDS

Summit Pointe will be developed, improved and utilized in such a manner that all properties will provide a harmonious, appealing appearance and function, that land uses will be compatible and complementary, and that property owners will be protected against any use of other land located in Summit Pointe which might unreasonably depreciate or detract from the value and use of their property.

Before beginning construction or alteration on any Summit Pointe property, owners must first submit plans and specifications to SPARC for written approval. Plan submittals are required for construction or alteration of any buildings, enclosures and fences, loading docks, parking facilities, storage areas, landscaping or any other structures or permanent improvements on or to any site.

Plans and specifications will show plot layout and all exterior elevations, with materials and colors therefore and structural design, signs and landscaping.

Approval is based on adequacy of site dimensions, storm drainage considerations, conformity and harmony of external design with neighboring structures, improvements, operations and uses, relation of topography, grade and finished ground elevation of the site being improved to that of neighboring sites and proper facing of main elevation with respect to nearby streets.

This section is intended to provide a single source for basic site development requirements and procedures in order to assist those interested in developing property or operating a business at Summit Pointe.

PROPERTY ASSESSMENTS

The Summit Pointe Owners’ Association is a non-profit property owner association operated for the benefit of all Summit Pointe property owners. It is represented and funded by the property owners of Summit Pointe. The amount of the budget and individual dues assessments are reviewed and approved during an annual meeting of the members called by the Summit Pointe Owners’ Association Board of Directors. These funds provide for the necessary oversight and property management of Summit Pointe’s many amenities, grounds maintenance and daily operations. The goal of the Summit Pointe Owners’ Association is to ensure overall aesthetic harmony in building development while preserving and enhancing the value of all businesses within the community.
